The controller responsible for the processing of personal data is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.

2) Data Collection When You Visit Our Website

2.1 When you use our website for information purposes only, i.e. if you do not register or otherwise send us information, we only collect the data that your browser transmits to the page server (so-called “server log files”). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:

  • The website of ours that you visited
  • Date and time of access
  • Amount of data sent in bytes
  • Source/referrer from which you reached the page
  • Browser used
  • Operating system used
  • IP address used (if applicable: in anonymised form)

The processing is carried out in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. However, we reserve the right to review the server log files retrospectively should specific indications point to unlawful use.

2.2 For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or enquiries to the controller), this website uses SSL or TLS encryption. You can recognise an encrypted connection by the character string “https://” and the padlock symbol in your browser bar.

3) Hosting & Content Delivery Network

Shopify

To host our website and display the page content, we use the system of the following provider: Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”)

Data is also transferred to: Shopify Inc., 150 Elgin St, Ottawa, ON K2P 1L4, Canada, Shopify Data Processing (USA) Inc., Shopify Payments (USA) Inc. or Shopify (USA) Inc.

All data collected on our website is processed on the provider's servers. We have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorised disclosure to third parties.

For a data transfer to Canada, an adequate level of data protection is ensured by an adequacy decision of the European Commission.

For the transfer of data to the USA, the provider relies on standard contractual clauses of the European Commission, which are intended to ensure compliance with the European level of data protection.

4) Cookies

To make your visit to our website attractive and to enable the use of certain functions, we use cookies, i.e. small text files that are stored on your end device. Some of these cookies are automatically deleted again when you close your browser (so-called “session cookies”), while others remain on your end device for longer and enable page settings to be saved (so-called “persistent cookies”). In the latter case, you can find the storage period in the overview of the cookie settings of your web browser.

Where individual cookies we use also process personal data, the processing is carried out in accordance with Art. 6 (1) (b) GDPR either to perform the contract, in accordance with Art. 6 (1) (a) GDPR if consent has been given, or in accordance with Art. 6 (1) (f) GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of your visit to the site.

You can set your browser so that you are informed about the setting of cookies and decide individually whether to accept them, or exclude the acceptance of cookies for certain cases or in general.

Please note that if you do not accept cookies, the functionality of our website may be limited.

5) Contacting Us

5.1 WhatsApp Business

We offer visitors to our website the option of contacting us via the messaging service WhatsApp of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. For this we use the so-called “Business version” of WhatsApp.

If you contact us via WhatsApp in connection with a specific transaction (for example, an order you have placed), we store and use the mobile phone number you use on WhatsApp and, if provided, your first and last name in accordance with Art. 6 (1) (b) GDPR to process and respond to your enquiry. On the basis of the same legal basis, we may ask you via WhatsApp to provide further data (order number, customer number, address or email address) so that we can assign your enquiry to a specific case.

If you use our WhatsApp contact for general enquiries (for example about our range of services, availability or our website), we store and use the mobile phone number you use on WhatsApp and, if provided, your first and last name in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in the efficient and timely provision of the information you request.

Your data is only ever used to respond to your enquiry via WhatsApp. It is not passed on to third parties.

Please note that WhatsApp Business gains access to the address book of the mobile device we use for this purpose and automatically transmits phone numbers stored in the address book to a server of the parent company Meta Platforms Inc. in the USA. To operate our WhatsApp Business account, we use a mobile device whose address book only stores the WhatsApp contact details of users who have also contacted us via WhatsApp.

This ensures that every person whose WhatsApp contact details are stored in our address book has already consented, upon first use of the app on their device by accepting the WhatsApp terms of use, to the transmission of their WhatsApp phone number from the address books of their chat contacts in accordance with Art. 6 (1) (a) GDPR. A transmission of data of users who do not use WhatsApp and/or have not contacted us via WhatsApp is therefore excluded.

For the purpose and scope of data collection and the further processing and use of the data by WhatsApp, as well as your rights and setting options in this regard to protect your privacy, please refer to WhatsApp's privacy notice: https://www.whatsapp.com/legal/?eea=1#privacy-policy

In the course of the processing described above, data may be transferred to servers of Meta Platforms Inc. in the USA.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European level of data protection on the basis of an adequacy decision of the European Commission.

5.2 When you contact us (e.g. via contact form or email), personal data is processed – solely for the purpose of handling and responding to your enquiry and only to the extent necessary for this.

The legal basis for processing this data is our legitimate interest in responding to your enquiry in accordance with Art. 6 (1) (f) GDPR. If your contact aims at a contract, the additional legal basis for the processing is Art. 6 (1) (b) GDPR. Your data will be deleted once it can be inferred from the circumstances that the matter concerned has been conclusively resolved, provided no statutory retention obligations stand in the way.

6) Comment Function

As part of the comment function on this website, in addition to your comment, details of the time the comment was created and the commenter name you chose are stored and published on this website. Your IP address is also logged and stored. This storage of the IP address takes place for security reasons and in case the person concerned infringes the rights of third parties or posts unlawful content through a comment. We need your email address to contact you if a third party objects to your published content as unlawful.

The legal bases for storing your data are Art. 6 (1) (b) and (f) GDPR. We reserve the right to delete comments if third parties object to them as unlawful.

7) Data Processing When Opening a Customer Account

In accordance with Art. 6 (1) (b) GDPR, personal data continues to be collected and processed to the extent required in each case if you provide it to us when opening a customer account. Which data is required for opening an account can be found in the input form of the corresponding form on our website.

You can delete your customer account at any time by sending a message to the controller's address given above. After your customer account is deleted, your data will be deleted, provided all contracts concluded through it have been fully completed, no statutory retention periods stand in the way and we no longer have a legitimate interest in continued storage.

8) Use of Customer Data for Direct Marketing

8.1 Subscription to Our Email Newsletter

If you subscribe to our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. Providing further data is voluntary and is used to address you personally. For sending the newsletter we use the so-called double opt-in procedure, which ensures that you only receive newsletters once you have expressly confirmed your consent to receive the newsletter by clicking a verification link sent to the email address provided

By activating the confirmation link, you give us your consent to the use of your personal data in accordance with Art. 6 (1) (a) GDPR. In doing so, we store your IP address assigned by your internet service provider (ISP) as well as the date and time of subscription, in order to be able to trace any misuse of your email address at a later point in time. The data we collect when you subscribe to the newsletter is used strictly for its intended purpose.

You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a message to the controller named at the beginning. After you have unsubscribed, your email address will be deleted from our newsletter distribution list without delay, unless you have expressly consented to further use of your data or we reserve the right to further use of data that is permitted by law and about which we inform you in this statement.

8.2 Shopping Cart Reminders by Email

If you abandon your purchase with us before completing the order, you have the option of being reminded once by email of the contents of your virtual shopping cart.

The only mandatory information for sending this reminder is your email address. Providing further data is voluntary and is used, where applicable, to address you personally. For sending the email we use the so-called double opt-in procedure, which ensures that you only receive a notification once you have expressly confirmed your consent in this regard by clicking a verification link sent to the email address provided.

By activating the confirmation link, you give us your consent to the use of your personal data in accordance with Art. 6 (1) (a) GDPR for sending a shopping cart reminder. In doing so, we store your IP address assigned by your internet service provider (ISP) as well as the date and time of subscription, in order to be able to trace any misuse of your email address at a later point in time. The data we collect when you subscribe to our email notification service is used strictly for its intended purpose.

You can unsubscribe from the shopping cart reminders at any time by sending a message to the controller named at the beginning. After you have unsubscribed, your email address will be deleted without delay from the distribution list set up for this purpose, unless you have expressly consented to further use of your data or we reserve the right to further use of data that is permitted by law and about which we inform you in this statement.

8.3 Advertising by Post
On the basis of our legitimate interest in personalised direct marketing, we reserve the right to store your first and last name, your postal address and – insofar as we have received these additional details from you in the course of the contractual relationship – your title, academic degree, year of birth and your occupational, industry or business designation in accordance with Art. 6 (1) (f) GDPR, and to use them to send you interesting offers and information about our products by post.
You can object to the storage and use of your data for this purpose at any time by contacting us.

9) Data Processing for Order Fulfilment

9.1 Where necessary for contract performance for delivery and payment purposes, the personal data we collect is passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 (1) (b) GDPR.

Where, on the basis of a corresponding contract, we owe you updates for goods with digital elements or for digital products, we process the contact details you provide when ordering (name, address, email address) in order to inform you personally, within the scope of our statutory information obligations under Art. 6 (1) (c) GDPR, by a suitable means of communication (e.g. by post or email) about upcoming updates within the legally prescribed period. Your contact details are used strictly for notifications about updates we owe and are processed by us for this purpose only to the extent required for the respective information.

To process your order, we also work with the following service provider(s), who support us in whole or in part in performing concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.

9.2 Use of Payment Service Providers (Payment Services)

- Apple Pay

If you choose the payment method “Apple Pay” of Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, payment is processed via the “Apple Pay” function of your iOS, watchOS or macOS device by debiting a payment card stored in “Apple Pay”. Apple Pay uses security features built into the hardware and software of your device to protect your transactions. To authorise a payment, you must therefore enter a code you previously set and verify yourself using the “Face ID” or “Touch ID” function of your device.

For the purpose of payment processing, the information you provide during the order process, together with the information about your order, is passed on to Apple in encrypted form. Apple then encrypts this data again with a developer-specific key before the data is transmitted to the payment service provider of the payment card stored in Apple Pay in order to carry out the payment. The encryption ensures that only the website through which the purchase was made can access the payment data. After the payment has been made, Apple sends your device account number and a transaction-specific, dynamic security code to the originating website to confirm that the payment was successful.

Where personal data is processed in the transmissions described, the processing is carried out solely for the purpose of payment processing in accordance with Art. 6 (1) (b) GDPR.

Apple retains anonymised transaction data, including the approximate purchase amount, the approximate date and time, and whether the transaction was completed successfully. Anonymisation completely rules out any link to a person. Apple uses the anonymised data to improve “Apple Pay” and other Apple products and services.

If you use Apple Pay on your iPhone or Apple Watch to complete a purchase you made via Safari on your Mac, the Mac and the authorising device communicate via an encrypted channel on Apple's servers. Apple does not process or store any of this information in a format that can identify you. You can disable the option to use Apple Pay on your Mac in the settings of your iPhone. Go to “Wallet & Apple Pay” and disable “Allow Payments on Mac”.

Further information on data protection with Apple Pay can be found at the following internet address: https://support.apple.com/de-de/HT203027

10.1 Google (Universal) Analytics

This website uses Google (Universal) Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), which enables an analysis of your use of our website.

By default, when you visit the website, Google (Universal) Analytics sets cookies, which are stored as small text blocks on your end device and collect certain information. This information includes your IP address, which Google, however, shortens by the last digits in order to rule out direct identifiability.

The information is transferred to Google's servers and processed further there. Transfers to Google LLC, based in the USA, are also possible.

Google Tag Manager provides a technical basis for bundling various web applications, including tracking and analytics services, and for calibrating, controlling and making them subject to conditions via a single user interface. Google Tag Manager itself does not store information on users' end devices or read it out. Nor does the service carry out any independent data analyses. 11) Retargeting/ Remarketing and Conversion Tracking

11.1 Facebook Pixel for Creating Custom Audiences with Advanced Matching (with Cookie Consent Tool)

Within our online offering, we use the service "Facebook Pixel" in advanced matching mode, provided by the following provider: Meta Platforms Ireland Limited, 4 Grand Canal Quare, Dublin 2, Ireland ("Facebook")

If a user clicks on an advertisement we have placed on Facebook, "Facebook Pixel" is used to extend the URL of our linked page with a parameter. After the redirect, this URL parameter is then entered into the user's browser by a cookie that our linked page itself sets. In addition, this cookie collects specific customer data such as the email address that we collect on our website linked to the Facebook ad during actions such as completed purchases, account logins or registrations (advanced matching). The cookie is then read and enables the data, including the specific customer data, to be transmitted to Facebook.

We use "Facebook Pixel" with advanced matching to make our Facebook advertisements (so-called Facebook Ads") more effective and to ensure that they match users' interests or have certain characteristics (e.g. interests in certain topics or products, determined on the basis of the websites visited) that we transmit to Facebook (so-called "Custom Audiences").

In addition, we analyse the effectiveness of our advertisements by tracking whether users were redirected to our website after clicking on an advertisement (conversion). Compared with the standard version of "Facebook Pixel", the advanced matching function helps us measure the effectiveness of our advertising campaigns better by capturing more attributed conversions.

All transmitted data is stored and processed by Facebook, so that assignment to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with Facebook's data use policy (https://www.facebook.com/about/privacy/). The data may enable Facebook and its partners to serve ads on and off Facebook.

All processing described above, in particular the setting of cookies for reading information on the end device used, only takes place if you have given us your express consent for this in accordance with Art. 6 (1) (a) GDPR. You can withdraw your consent at any time with effect for the future by deactivating this service in the “cookie consent tool” provided on the website.

We have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorised disclosure to third parties.

The information generated by Facebook is generally transferred to a Facebook server and stored there; in this context, a transfer to servers of Meta Platforms Inc. in the USA may also occur.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European level of data protection on the basis of an adequacy decision of the European Commission.

11.2 Google Ads Conversion Tracking

This website uses the online advertising programme "Google Ads" and, as part of Google Ads, conversion tracking provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).

We use Google Ads to draw attention to our attractive offers by means of advertising materials (so-called Google Adwords) on external websites. Based on the data from the advertising campaigns, we can determine how successful the individual advertising measures are. Our aim is to show you advertising that is of interest to you, to make our website more interesting for you and to achieve a fair calculation of the advertising costs incurred.

The cookie for conversion tracking is set when a user clicks on an Ads advertisement placed by Google. Cookies are small text files that are stored on your end device. These cookies generally expire after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognise that the user clicked on the advertisement and was redirected to this page. Each Google Ads customer receives a different cookie. Cookies therefore cannot be tracked across the websites of Google Ads customers. The information obtained with the help of the conversion cookie is used to create conversion statistics for Google Ads customers who have opted for conversion tracking. Customers learn the total number of users who clicked on their advertisement and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

As part of the use of Google Ads, personal data may also be transferred to the servers of Google LLC in the USA.

Details on the processing triggered by Google Ads conversion tracking and on Google's handling of data from websites can be found here: https://policies.google.com/technologies/partner-sites

You can also permanently object to the setting of cookies by Google Ads conversion tracking by downloading and installing the Google browser plug-in available at the following link:
https://www.google.com/settings/ads/plugin?hl=de

To address users whose data we have received in the course of business or business-like relationships with even more interest-based advertising, we use a customer matching function as part of Google Ads. For this purpose, we transmit one or more files with aggregated customer data (above all email addresses and phone numbers) electronically to Google. Google does not gain access to plain data in the process, but automatically encrypts the information in the customer files during the transmission process using a special algorithm. The encrypted information can then only be used by Google to match it to existing Google accounts that the data subjects have set up. This enables personalised advertising to be delivered across all Google services linked to the respective Google account.

Customer data is only transmitted to Google if you have given us your express consent for this in accordance with Art. 6 (1) (a) GDPR. You can withdraw this consent from us at any time with effect for the future. 12) Site Functionalities

12.1 Instagram Plugins

Plugins of the social network of the following provider are used on our website: Meta Platforms Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland

These plugins enable direct interactions with content on the social network.

To increase the protection of your data when you visit our website, the plugins are initially integrated into the page in a deactivated state by means of a so-called “2-click” or “Shariff” solution.

This integration ensures that, when a page of our website containing such plugins is accessed, no connection to the provider's servers is established yet.

Only when you activate the plugins, and thereby give your consent to the data transfer in accordance with Art. 6 (1) (a) GDPR, does your browser establish a direct connection to the provider's servers. In doing so, regardless of whether you are logged in to an existing user profile, certain information about your end device (including your IP address), your browser and your page history is transmitted to the provider and may be processed further there.

If you are logged in to an existing user profile on the provider's social network, information about interactions carried out via the plugins is also published there and displayed to your contacts.
You can withdraw your consent at any time by deactivating the activated plugin again by clicking on it once more. However, the withdrawal does not affect the data that has already been transmitted to the provider.

Data may also be transferred to: Meta Platforms Inc., USA

We have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorised disclosure to third parties.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European level of data protection on the basis of an adequacy decision of the European Commission.

12.3 Google reCAPTCHA

On this website we use the CAPTCHA service of the following provider: Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland

Data may also be transferred to: Google LLC, USA. For the visual design of the captcha window, the provider uses “Google Fonts", i.e. fonts loaded from the internet by Google. No further information is processed here beyond that mentioned above, which is already transmitted to Google via the functionality of reCAPTCHA.

The service checks whether an entry is made by a natural person or abusively by machine-based and automated processing, and blocks spam, DDoS attacks and similar automated malicious access. To ensure that an action is carried out by a human and not by an automated bot, the provider collects the IP address of the end device used, identification data on the browser and operating system type used as well as the date and duration of the visit, and transmits this to the provider's servers for evaluation.

The legal basis is our legitimate interest in establishing individual personal responsibility on the internet and in preventing misuse and spam in accordance with Art. 6 (1) (f) GDPR.

Details of the application can be found in the job advertisement.

After receipt of the application by email, the data is stored and evaluated solely for the purpose of processing the application. Cumulatively or alternatively, the processing of the special categories of data may also be based on Art. 9 (1) (h) GDPR if it is carried out for the purposes of preventive healthcare or occupational medicine, for assessing the applicant's capacity to work, for medical diagnosis, the provision of care or treatment in the health or social sector, or for the management of systems and services in the health or social sector.

If the applicant is not selected or an applicant withdraws their application prematurely, their transmitted data and all electronic correspondence, including the application email, will be deleted after a corresponding notification, at the latest after 6 months. This period is based on our legitimate interest in answering any follow-up questions about the application and, where applicable, in being able to meet our obligations to provide evidence under the rules on equal treatment of applicants.

In the event of a successful application, the data provided will be processed on the basis of Art. 6 (1) (b) GDPR (for processing in Germany in conjunction with Section 26 (1) BDSG) for the purpose of carrying out the employment relationship.

When the form is submitted, the applicant data is transmitted to us in encrypted form in accordance with the state of the art, stored by us and evaluated solely for the purpose of processing the application. The processing is carried out on the basis of Art. 6 (1) (b) GDPR (or Section 26 (1) BDSG), within the meaning of which going through the application procedure is deemed to be the initiation of an employment contract.

Insofar as special categories of personal data within the meaning of Art. 9 (1) GDPR (e.g. health data such as information on severe disability status) are requested from applicants during the application procedure, the processing is carried out in accordance with Art. 9 (2) (b) GDPR, so that we can exercise the rights arising from employment law and the law of social security and social protection and comply with our obligations in this regard.

If the applicant is not selected or an applicant withdraws their application prematurely, their data transmitted via the form and all electronic correspondence, including the application email, will be deleted after a corresponding notification, at the latest after 6 months. This period is based on our legitimate interest in answering any follow-up questions about the application and, where applicable, in being able to meet our obligations to provide evidence under the rules on equal treatment of applicants.

13.2 Cookie Consent Tool

To obtain valid user consent for cookies and cookie-based applications that require consent, this website uses a so-called “cookie consent tool”. The “cookie consent tool” is displayed to users when a page is accessed in the form of an interactive user interface on which consent for certain cookies and/or cookie-based applications can be given by ticking a box. Through the use of the tool, all cookies/services requiring consent are only loaded if the respective user gives the corresponding consent by ticking a box. This ensures that such cookies are only set on the respective user's end device if consent has been given.

The tool sets technically necessary cookies to store your cookie preferences. Personal user data is generally not processed in this context.

If, in an individual case, personal data (such as the IP address) is nevertheless processed for the purpose of storing, assigning or logging cookie settings, this is done in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in legally compliant, user-specific and user-friendly consent management for cookies and, therefore, in a legally compliant design of our website.

A further legal basis for the processing is Art. 6 (1) (c) GDPR. As controller, we are subject to the legal obligation to make the use of technically non-essential cookies dependent on the respective user's consent.

Where necessary, we have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorised disclosure to third parties.

Further information on the operator and the setting options of the cookie consent tool can be found directly in the corresponding user interface on our website.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, FURTHER PROCESSING REMAINS RESERVED IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF WE PROCESS YOUR PERSONAL DATA FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

If statutory retention periods exist for data processed in the context of legal transactions or quasi-contractual obligations on the basis of Art. 6 (1) (b) GDPR, this data is routinely deleted after the retention periods expire, provided it is no longer required for performing or initiating the contract and/or we no longer have a legitimate interest in continued storage.

When personal data is processed on the basis of Art. 6 (1) (f) GDPR, this data is stored until you exercise your right to object under Art. 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

When personal data is processed for the purpose of direct marketing on the basis of Art. 6 (1) (f) GDPR, this data is stored until you exercise your right to object under Art. 21 (2) GDPR.

Unless the other information in this statement on specific processing situations provides otherwise, stored personal data is otherwise deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
