Withdrawal instructions and returns terms

Here you will find everything about withdrawing from your order: who has the statutory right of withdrawal, the withdrawal instructions (section A), the model withdrawal form (section B) and our returns terms for deliveries outside the European Union, Iceland, Liechtenstein, Norway and the United Kingdom (section C).

Who has the right of withdrawal?

You have the statutory right of withdrawal under the withdrawal instructions below if you order as a consumer and your place of residence (habitual residence) or your delivery address is in a Member State of the European Union, in Iceland, Liechtenstein, Norway or the United Kingdom. The European Union here also includes territories such as Åland, French Guiana, Guadeloupe, Martinique, Mayotte, Réunion and Saint-Martin.

A consumer is any natural person who enters into a contract for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

If both your place of residence and your delivery address are outside the European Union, Iceland, Liechtenstein, Norway and the United Kingdom, this right of withdrawal does not apply under our contractual terms (see section C). Rights that you have under the mandatory consumer law of your country of residence remain unaffected. You have your statutory rights in the event of defects in any case.

What counts is your place of residence and your delivery address at the time of the order. Your nationality does not matter.

We reproduce the withdrawal instructions (section A) and the model withdrawal form (section B) in the statutory model wording, which is why the wording there is more formal.

A. Withdrawal instructions

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the last good.

By way of derogation, in the case of a contract for regular delivery of goods during a defined period of time, the withdrawal period will expire after 14 days from the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the first good.

To exercise the right of withdrawal, you must inform us (Rudolf Latikan, Technostoff, Dennhäuser Str. 116, 34134 Kassel, Germany, tel.: +49 1520 6087940, e-mail: support@technostoff.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at https://technostoff.com/en/pages/widerruf. If you use this online function, we will communicate to you without delay, on a durable medium (e.g. by e-mail), an acknowledgement of receipt with information on the content of the withdrawal statement and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion and early expiry of the right of withdrawal

The right of withdrawal does not exist for contracts for the supply of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive, or that are clearly tailored to the consumer's personal needs.

What this means for us: we make or finish our items only after you order them (“made to order”). That alone does not exclude your right of withdrawal. If you order an item from our range and only choose from the motifs, colours and sizes we offer, you can withdraw from the purchase. Withdrawal is excluded only for items that we make to your own specifications, for example with a motif, text, name or logo that you supply or determine (see section 9 of our Terms of Service).

Under section 312g(2) no. 9 of the German Civil Code (BGB), unless otherwise agreed, there is no right of withdrawal for contracts for services related to leisure activities if the contract provides for a specific date or period of performance. Accordingly, the right of withdrawal is also excluded for contracts for the sale of tickets for leisure events tied to a specific date.

General notes on returns

1) Please avoid damaging or soiling the goods. Please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please make sure the goods are adequately protected against transport damage with suitable packaging.
2) Please do not send the goods back to us unpaid (carriage forward).
3) Please note that points 1–2 above are not a condition for the valid exercise of the right of withdrawal.

B. Model withdrawal form

If you want to withdraw from the contract, you can simply use our withdrawal form or inform us by an unequivocal statement (e.g. by e-mail or with the model form below). Using the model form is not obligatory. If you have a customer account, you can alternatively initiate the return via your customer account.

C. Returns terms for deliveries outside the EU, Iceland, Liechtenstein, Norway and the United Kingdom

If both your place of residence and your delivery address are outside the European Union, Iceland, Liechtenstein, Norway and the United Kingdom, the right of withdrawal from section A does not apply under our contractual terms (section 3.3 of our Terms of Service).

If only your delivery address is outside these countries but your place of residence is in one of them, you have the right of withdrawal under section A. You can then declare your withdrawal as described there, including via our withdrawal page.

We do not offer voluntary returns beyond this. If you would like a different size or colour, feel free to write to us with your order number and the variant you want. We will then see what is possible. This does not constitute a promise of an exchange.

Rights that you have under the mandatory consumer law of your country of residence remain unaffected. This may also include a statutory right of withdrawal or return provided for there.
